Terms of Service
These terms govern your use of excelsiorforge.com and anything we offer through it (the "Services"). By using the site you agree to them. If you do not agree, please do not use the site.
1. Who we are
Excelsior Forge builds and runs revenue systems for B2B companies. This site is an informational and lead-generation surface for that work. It is not the product itself, and using it does not start an engagement.
2. Who can use the site
You need to be at least 18 years old and able to enter a binding contract. By using the site you confirm that you are.
3. Using the site
Use the site lawfully. You agree not to break any law while using it, try to gain unauthorized access to it or the systems behind it, disrupt or overload it, scrape or harvest information from it without our written permission, use it to send spam or unsolicited promotions, or try to reverse engineer any part of it.
4. Our content
Everything on the site, including the text, graphics, logos, the frameworks and playbooks we publish, and the code, belongs to Excelsior Forge or our licensors and is protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive license to view it so you can evaluate working with us. Anything beyond that needs our written permission.
5. Feedback
If you send us ideas, suggestions, or feedback through the site, you let us use them freely for any purpose, with no obligation to you. Please do not send us confidential information through the site.
6. Other companies' services
The site links to and uses third-party tools, such as Cal.com for scheduling and the analytics providers described in our Privacy Policy. We are not responsible for those services, and your use of them is governed by their own terms.
7. Our paid work
Any paid engagement is governed by a separate written agreement, such as a statement of work. Nothing on this site is a binding offer of services, and an engagement begins only when we both sign that agreement.
8. No guarantees
The site is provided "as is" and "as available." We do not promise it will be uninterrupted, error-free, or perfectly secure, or that everything on it is exact. Any results, case studies, or examples reflect specific situations and are not a promise of what you will get.
9. Limit on liability
To the maximum extent the law allows, Excelsior Forge will not be liable for any indirect, incidental, special, or consequential damages, or for lost profits, revenue, data, or goodwill, arising from your use of the site. Our total liability for anything related to the site will not exceed one hundred U.S. dollars (USD $100).
10. Indemnification
You agree to cover us for any claims, losses, and costs, including reasonable legal fees, that arise from your use of the site or your breach of these terms.
11. Suspension
We may suspend or end your access to the site at any time, including for a breach of these terms. The parts that are meant to last, including our content rights, the disclaimers, the limit on liability, and indemnification, survive after access ends.
12. Changes to these terms
We may update these terms from time to time. The current version is always posted here with its date. If you keep using the site after a change takes effect, you accept the updated terms.
13. Governing law
These terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. You agree that any dispute relating to these terms or the site will be handled exclusively in the state or federal courts located in Texas.
